These Terms of Service govern your access to and use of the Dallas Card Shop website, online store, products, and services (collectively, the “Services”).

Dallas Card Shop is powered by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.

By visiting the store, placing an order, creating an account, or otherwise using the Services, you agree to these Terms of Service, our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree to these terms, do not use the Services.

1. Eligibility

You must be at least the age of majority in your jurisdiction to make a purchase or create an account.

If you allow a minor to use the Services, you are responsible for their activity and purchases.

You may not use the Services for unlawful, fraudulent, abusive, or unauthorized purposes.

2. Customer Accounts

You are responsible for providing accurate account information and keeping your login credentials secure.

Notify us promptly if you suspect unauthorized access to your account.

We may suspend or terminate accounts reasonably believed to be involved in fraud, abuse, unauthorized activity, or violations of these terms.

3. Product Listings

We make reasonable efforts to describe each card accurately, including its condition, grading information, set, card number, language, rarity, and other relevant details.

Product photographs form part of the listing. For individually photographed cards, the card shown is intended to be the card the customer receives unless the listing clearly states otherwise.

Colors and details may appear differently depending on lighting, photography, screen settings, and device display.

Minor manufacturing variations, printing differences, centering, surface characteristics, and other disclosed condition details are not considered defects when accurately shown or described.

4. Raw and Graded Cards

Raw or ungraded card conditions reflect our good-faith assessment and are not a guarantee that a third-party grading company will assign a particular grade.

We do not guarantee future grading results, population reports, market prices, resale value, or investment performance.

For graded cards, the grading company, grade, certification number, and certification link are included when available. Third-party grading companies are independent organizations, and Dallas Card Shop does not control their decisions, standards, databases, or services.

Do not purchase collectible cards as a guaranteed investment.

5. Prices and Availability

Prices are displayed in the currency shown at checkout and may change without notice.

A product is not reserved until checkout is completed. Items placed in a cart may still be purchased by another customer.

Because many collectible cards are unique or have a quantity of one, inventory errors can occasionally occur. If an unavailable item is purchased, we may cancel the affected item and issue a refund.

We may correct pricing, description, inventory, or typographical errors at any time. If an error materially affects an order, we may contact the customer, cancel the affected item, or issue a refund.

6. Orders

We reserve the right to accept, reject, limit, or cancel an order when reasonably necessary, including for:

• Suspected fraud or unauthorized payment.

• Incorrect pricing or product information.

• Inventory errors.

• Shipping restrictions.

• Resale abuse or automated purchasing activity.

• Violations of these terms or another store policy.

We may limit quantities purchased per person, household, account, payment method, or shipping address.

If we cancel a paid order, we will issue an appropriate refund to the original payment method.

7. Payments

Payments are processed through Shopify Payments or another payment provider displayed at checkout.

You represent that:

• The payment information you provide is accurate.

• You are authorized to use the selected payment method.

• You authorize the applicable charges, taxes, shipping costs, and other disclosed fees.

Payment providers and financial institutions may apply their own terms, verification requirements, holds, or processing times.

8. Shipping and Delivery

Shipping availability, processing times, rates, estimated delivery dates, tracking, address requirements, and damaged-package procedures are described in our Shipping Policy.

Delivery dates are estimates and are not guaranteed.

Customers are responsible for providing a complete and accurate delivery address. We cannot guarantee address changes after an order enters fulfillment.

Risk associated with shipping claims will be handled according to applicable law, carrier procedures, and our Shipping Policy.

9. Returns and Refunds

Because trading cards are collectibles whose condition and market value may change, all sales are final except as provided in our Refund Policy or required by applicable law.

Review the product listing, photographs, condition details, and Refund Policy before purchasing.

Our Refund Policy is incorporated into these Terms of Service.

10. Authenticity

We do not knowingly sell counterfeit cards.

If you believe an item is counterfeit or materially different from its listing, contact us promptly and preserve the item, packaging, and supporting documentation.

Eligibility for a return or refund is governed by our Refund Policy and applicable law.

11. Promotions and Discount Codes

Promotions, discount codes, gift cards, and special offers may be subject to additional conditions.

Unless stated otherwise:

• Discounts cannot be combined.

• Offers have no cash value.

• Promotions may be changed or ended at any time.

• Discounts cannot be applied retroactively.

• Fraudulent or unauthorized use may result in cancellation.

12. Store Content and Intellectual Property

The Services and their original content—including store branding, text, graphics, layout, photographs, and design—are owned by or licensed to Dallas Card Shop and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, scrape, modify, sell, or commercially exploit store content without permission.

Pokémon and related names, characters, artwork, and trademarks belong to their respective owners. Dallas Card Shop is an independent retailer and is not affiliated with or endorsed by Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company, or their affiliates.

13. Reviews, Feedback, and Submissions

If you submit reviews, feedback, photos, suggestions, or other content, you grant Dallas Card Shop permission to use, reproduce, edit, display, and distribute that content for store operations and marketing, subject to applicable law.

You represent that your submission:

• Is accurate and based on a genuine experience.

• Does not violate another person’s rights.

• Is not unlawful, threatening, defamatory, deceptive, obscene, or malicious.

• Does not contain harmful code, spam, or unauthorized advertising.

We may remove content that violates these requirements.

14. Prohibited Uses

You may not use the Services to:

• Violate any applicable law or regulation.

• Commit fraud or provide false information.

• Infringe intellectual-property or privacy rights.

• Transmit malware, harmful code, or automated attacks.

• Scrape, crawl, or copy store data without authorization.

• Interfere with store security or operation.

• Harass, threaten, impersonate, or harm another person.

• Circumvent purchase limits or security controls.

• Conduct unauthorized resale, payment testing, or chargeback abuse.

We may restrict access or cancel orders associated with prohibited activity.

15. Third-Party Services and Links

The Services may include tools, payment services, integrations, or links operated by third parties.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites, services, content, availability, security, or business practices.

Use third-party services at your own discretion.

16. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

Shopify also processes information relating to your use of the Services. Review Shopify’s applicable privacy policies for additional information.

17. Disclaimer of Warranties

To the maximum extent permitted by law, the Services and products are provided on an “as available” and “as described” basis.

Except for warranties that cannot legally be excluded, we do not make warranties regarding:

• Uninterrupted or error-free access to the Services.

• Future card value or investment performance.

• Third-party grading outcomes.

• Compatibility with a particular collection or use.

• Third-party websites, carriers, payment providers, or grading companies.

Nothing in these terms excludes warranties or consumer rights that cannot legally be waived.

18. Limitation of Liability

To the maximum extent permitted by law, Dallas Card Shop and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, lost opportunities, or changes in collectible value.

Where liability cannot be excluded, our total liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Dallas Card Shop harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the Services, your violation of these terms, or your infringement of another person’s rights.

20. Severability

If any provision of these terms is found unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

21. No Waiver

Our failure to enforce a provision does not waive our right to enforce it later.

22. Termination

We may suspend or terminate access to the Services for violations of these terms, fraud, abuse, unlawful activity, or threats to store security.

Provisions that should reasonably survive termination will remain effective, including payment obligations, ownership provisions, disclaimers, and limitations of liability.

23. Governing Law

These terms are governed by the laws applicable where Dallas Card Shop is established, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.

24. Changes to These Terms

We may update these Terms of Service to reflect changes to the Services, business practices, or legal requirements.

The revised terms become effective when posted, unless a different date is stated. Continued use of the Services after an update constitutes acceptance of the revised terms to the extent permitted by law.
